1. Acceptance of Terms
By accessing or using beMYN (the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access or use the Service. These terms apply to all visitors, users, and others who access the Service.
2. Description of Service
beMYN provide a platform for creating, customizing, and sharing interactive digital Valentine's cards and experiences. We offer both free and paid (premium) templates. The Service includes various modules like games, message reveals, and multimedia integration.
3. User Content & Conduct
You bear sole responsibility for all content (text, images, media) you upload or display via the Service. You represent and warrant that you have obtained all necessary consents, licenses, and permissions from any individuals depicted in your content before posting. beMYN assumes no liability or responsibility for user-generated content, including explicit or unauthorized images. Any violation of these terms will result in immediate account termination, deletion of the offending content without notice, and potential reporting to law enforcement.
4. Payments & Premium Content
Certain templates are available for a one-time purchase fee. Payments are processed securely through Stripe. Once a template is purchased, it is linked to your account for unlimited use for that specific experience. Due to the immediate digital nature of our premium content, all sales are final. We do not offer refunds, exchanges, or cancellations once a purchase is completed.
5. Intellectual Property
The templates, designs, branding, and code of beMYN are the exclusive property of beMYN. Users are granted a limited license to use these for personal, non-commercial purposes. Any redistribution or commercial use of our template logic is strictly prohibited.
6. Limitation of Liability
beMYN is provided "as-is" without warranties. Under no circumstances will beMYN be liable in any way for any content or materials of any third parties (including users), or for any loss or damage incurred as a result of the use of such content. We are not liable for data loss, service interruptions, or the reception of your digital card. You agree to indemnify and hold beMYN harmless from any claims arising from your User Content.
7. Age Requirements
You must be at least 13 years of age (or the minimum legal age in your country) to use the Service. By using beMYN, you represent that you meet this age requirement. If you are under the required age, you must not use our platform or provide any personal information to us.
8. Dispute Resolution & Governing Law
These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. You agree that any dispute arising from these Terms or the Service shall be resolved through binding, individual arbitration in Ontario, and you waive your right to participate in a class-action lawsuit or class-wide arbitration.
9. Copyright & DMCA Policy
beMYN respects the intellectual property rights of others. If you believe your copyright-protected work was posted on beMYN without authorization, you may submit a copyright infringement notification. We respond quickly to valid Digital Millennium Copyright Act (DMCA) takedown notices and reserve the right to terminate the accounts of repeat infringers.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
11. General Disclaimer & No Professional Advice
Any content provided via the beMYN blog or templates (e.g., event planning tips, wording suggestions) is for informational purposes only and does not constitute professional event coordination or legal advice. We are not responsible for the outcome of any event planned using our tools.
